So what is  your approach on this? Are you going to address the issues
or return the item?

Yeh,
caliper is compressed.  I think it's a geometry issue or the pads are
slightly too large.    I found someone with the same issue and
he had this to say: " We had exactly the same problem with the AAJ
set up. Like you more so on one side than on the other...
  The
caliper is not supposed to touch the bracket but is free floating on the
bolts. Only the bushings in the caliper ears get tightened snug against the
bracket, the caliper itself is supposed to be able to slide back and forth
on these bushings so it can center itself on the disc and have equal pad
pressure on both sides of the disc.
The problem is the alignment of the
caliper in relation to the disc. It's pressing against one side of the
disc. (you can turn this story around too...)
  If the adaptor sleeve
on the shaft sits properly all the way on the shaft flush against the stop
then you need to change the 4 small bushings that space out the bracket,
remove material from these or use thicker bushings so the bracket/caliper
moves inwards/outwards so there's no contact between the pads and the
disc... Alternatively you can also change the adaptor sleeve to suit,
moving the disc inward or outward in relation to where the caliper
  sits...
Remember that the caliper only moves in one sideways direction
when the brakes are applied and it needs to be able to slide enough on
the bushings/bolts to make up for pad wear and so remain self
  adjusting... "
